JUDGMENT AND PROBATION/COMMITMENT ORDER

X GUILTY, and the court being satisfied that there is a factual basis for the plea. NOLO
There being a finding/verdict of X GUILTY, defendant has been convicted as charged of the offense(s) of:
43 C.F.R. § 8341.1(f)(3), Driving Under the Influence of Alcohol
The defendant shall pay to the United States a special assessment of $25.00 which is due immediately.
The defendant shall pay to the United States a total fine of $390, which shall bear interest as provided by law.
The defendant shall comply with General Order No. 01-05.
Pursuant to the Sentencing Reform Act of 1984, it is the judgment of the Court that the defendant, Edward J. Niemela, is hereby placed on probation on the Single-Count Information for a term of one year under the following
1) The defendant shall comply with the rules and regulations of the United States Probation Office and General Order 05-02;
2) The defendant shall participate in monthly alcohol counseling meetings, which may include Alcoholics Anonymous meetings, at the direction of the Probation Officer; and
3) During the period of community supervision the defendant shall pay the special assessment and fine in accordance with the Court's orders pertaining to such payment.
The drug condition mandated by statue is suspended based on the Court's determination that the defendant poses a low risk of future drug abuse.
In addition to the special conditions of supervision imposed above, it is hereby ordered that the Standard Conditions of Probation and Supervised Release within this judgment be imposed.
