BRIEFING SCHEDULE: MOTION TO AMEND
The Court is in receipt of Plaintiff's letter of October 18, 2010. Dkt. No. 31. The subject of the letter is Plaintiff's request for permission to amend his complaint to add two additional defendants, the City of Fairfield and Solano County.
The Court will treat Plaintiff's letter as a motion to amend pursuant to FRCP 15(a)(2). As Plaintiff did not obtain the written consent of the current defendants, the Court will permit responsive briefing from both sides on the issue of whether the motion to amend should be granted. The briefing will proceed on the following schedule:
Defendants' Response November 2, 2010 Plaintiff's Reply November 9, 2010 Neither sides' briefing shall exceed 6 pages.
The parties are reminded that November 5, 2010 is the deadline for all pretrial motions except motions to compel.
The Clerk of the Court is directed to provide copies of this order to Plaintiff and all counsel.
