ORDER REQUIRING DEFENDANT TO FILE RESPONSE TO PLAINTIFF'S MOTION FOR ATTORNEY FEES AND COSTS UNDER THE EQUAL ACCESS TO JUSTICE ACT, 24 U.S.C. § 2412(d)

On October 20, 2010, Plaintiff filed a Motion for Attorney Fees and Costs pursuant to the Equal Access to Justice Act, 28 U.S.C. § 2412(d). (Doc. 22). Plaintiff's counsel states that he attempted to contact Defendant's counsel by email to settle this matter but Plaintiff's counsel failed to respond.

Accordingly, IT IS HEREBY ORDERED that Defendant shall have until Friday, November 19, 2010, to file a response to the Motion to for Attorney Fees and Costs.

IT IS SO ORDERED.
