STIPULATION AND [PROPOSED] ORDER CONTINUING CASE MANAGEMENT

WHEREAS, plaintiff Charles Wozniak filed a complaint against Defendants Align Technology, Inc. and Thomas M. Prescott on August 11, 2009; appointed as Lead Plaintiff; conference for September 10, 2010, and on January 8, 2010, the Court entered an Order setting a briefing schedule for Defendants' motion to dismiss;

WHEREAS, on November 13, 2009, Plumbers and Pipefitters National Pension Fund was

WHEREAS, on December 2, 2009, the Court entered an Order setting a case management

WHEREAS, Lead Plaintiff filed the Amended Complaint for Violations of Federal Securities Laws ("Amended Complaint") against Defendants Align Technology, Inc. and Thomas M. Prescott 10 on January 29, 2010;

WHEREAS, Defendants moved to dismiss the Amended Complaint on March 26, 2010;

WHEREAS, on May 21, 2010, Lead Plaintiff opposed Defendants' motion to dismiss;

WHEREAS, the Court took Defendants' motion under submission on July 7, 2010; and

WHEREAS, on August 24, 2010, the Court entered an Order continuing the September 10, 2010 case management conference to December 10, 2010 at 10:30 a.m.;

NOW, THEREFORE, in the interest of judicial economy and good cause showing, the Parties, by and through their undersigned counsel of record, hereby agree and stipulate that the case management conference currently scheduled for December 10, 2010 at 10:30 a.m. be continued to

The Parties respectfully request that the Court enter an Order approving this Stipulation.
