ORDER TO REDUCE DEFENDANT'S

THE FEDERAL RULES OF CRIMINAL SENTENCE PURSUANT TO RULE 35 OF PROCEDURE.

On November 23, 2010, the United States of American, represented by United States Attorney Benjamin B. Wagner and Executive Assistant U.S. Attorney Laurel D. White, moved to reduce defendant Nathan ALLEN's sentence from 160 months to 130 months, pursuant to Rule 35(b) of the Federal Rules of Criminal Procedure. The government's motion was based on the additional assistance defendant ALLEN has provided to the government. For the reasons set forth in the Government's Motion and the Defendant's Stipulated Agreement with the Government's Motion filed November 23, 2010, and for good cause appearing, the Court grants the government's motion and hereby orders that the defendant's 160-month term of imprisonment, previously imposed by this Court, be reduced to 130 months. The amended judgment shall reflect the new term of 130 months imprisonment. All other terms of the original judgment shall remain in effect.
