MOTION FOR EXTENSION OF TIME TO FILE DEFENDANT'S CROSS-MOTION FOR SUMMARY JUDGMENT; PROPOSED

ORDER

Defendant, through his attorney undersigned, moves this Court for an Order granting Defendant an additional forty-five days to respond to Plaintiff's Motion for Summary Judgment, up 20 to and including February 7, 2011. Defendant, seeks an extension by motion rather than by 21 stipulation because Defendant is unable to reach Plaintiff's counsel by telephone to obtain her 22 authorization to stipulate.

This request is being made because counsel for Defendant needs additional time to review this case.
