STIPULATION VACATING IN CAMERA HEARING AND TRIAL DATES AND
RESETTING FOR PLEA AND SENTENCE AND ORDER THEREON
IT IS HEREBY STIPULATED by and between the parties hereto that the in camera hearing and trial dates presently scheduled for February 14, 2011 and February 23, 2011, respectively, may be vacated, and a change of plea and sentencing hearing be scheduled for April 5, 2011, at 9:00 a.m.
The reason for vacating these hearings is that the parties came to an agreement in this matter. The requested continuance will conserve time and resources for both counsel and the Court and also allow for continuity of counsel in these proceedings.
The parties agree that the delay resulting from the continuance shall be excluded in the interests of justice, including but not limited to, the need for the period of time set forth herein for further defense preparation pursuant to 18 U.S.C. §§ 3161(h)(7)(A) and (B).
Based upon the plea agreement, the trial, scheduled for February 23, 2011 and all associated deadlines, are VACATED. Time is excluded in the interests of justice pursuant to 18 U.S.C. §§ 3161(h)(7)(A) and (B).
IT IS SO ORDERED.
