Berlan Lynell Dicey v. W. R. Harrison

IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF CALIFORNIA

March 3, 2011

BERLAN LYNELL DICEY, PLAINTIFF,
v.
W. R. HARRISON, ET AL., DEFENDANTS.

The opinion of the court was delivered by: John A. Mendez United States District Judge

ORDER

On January 31, 2011, plaintiff filed a motion for reconsideration of the magistrate judge's order filed January 4, 2011, denying in part plaintiff's motion for a sixty day extension of time to conduct discovery in this action.*fn1 Defendants oppose the motion. Pursuant to E.D. Local Rule 303(f), a magistrate judge's orders shall be upheld unless "clearly erroneous or contrary to law." Upon review of the entire file, the court finds that it does not appear that the magistrate judge's ruling was clearly erroneous or contrary to law.

Therefore, IT IS HEREBY ORDERED that, upon reconsideration, the order of the magistrate judge filed January 4, 2011, is affirmed.
