MOTION AND [PROPOSED] ORDER CONTINUING DATE AND EXCLUDING TIME UNDER 18 U.S.C. § 3161
On March 22, 2011, the parties in this case appeared before the Court. The Court granted the defendant's request for appointment of new counsel and set the matter to Judge Spero's calendar for appointment of new counsel. New counsel, Josh Cohen, will appear before Judge Spero for appointment on March 30, 2011. The matter was also set before this Court for status on March 29, 2011, having anticipated the appointment of new counsel. However, Mr. Cohen is unavailable on March 29, 2011. For this reason the parties have requested that the matter be scheduled before this Court on April 5, 2011.
For the reasons stated above and at the March 22, 2011 hearing, the matter is continued to 3 April 5, 2011, and the Court finds that the exclusion from the time limits applicable under 18 4 U.S.C. § 3161 of the period from March 22, 2011 through April 5, 2011 is warranted and that the 5 ends of justice served by the continuance outweigh the best interests of the public and the 6 defendant in a speedy trial. 18 U.S.C. §3161(h)(7)(A). The failure to grant the requested 7 exclusion of time would unreasonably deny the defendant reasonable time to obtain counsel. 18 8 U.S.C. §3161(h)(7)(B)(iv). 9 IT IS SO ORDERED.
