ORDER ON PLAINTIFF'S MOTION FOR AN EXTENSION OF TIME (Doc. 16)

On March 18, 2011, the Court granted the parties' stipulated request that Plaintiff be permitted to file an opening brief on or before April 13, 2011, that Defendant be permitted to file an opposition brief or before May 13, 2011, and that Plaintiff be permitted to file a reply brief on or before May 27, 2011.

On March 14, 2011, Plaintiff filed an opening brief and simultaneously requested that the Court grant an extension of time to file the brief, nunc pro tunc. (Doc. 16.) Plaintiff requested that the Commissioner also be granted a one-day extension of time to file an opposition brief. The Commissioner filed a statement of non-opposition to Plaintiff's motion. (Doc. 17.)

Accordingly, it is HEREBY ORDERED THAT:

1. Plaintiff's request for a one-day extension of time to file an opening brief is GRANTED nunc pro tunc;

2. Defendant shall file an opposition brief on or before May 14, 2011; and

3. Plaintiff may file a reply brief on or before May 27, 2011.

IT IS SO ORDERED.
