Hung Duong Nguon v. Tim v. Virga

IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF CALIFORNIA

May 18, 2011

HUNG DUONG NGUON, PLAINTIFF,
v.
TIM V. VIRGA, DEFENDANT.

ORDER

Plaintiff is a state prisoner proceeding pro se with a civil rights action pursuant to 42 U.S.C. § 1983. Plaintiff, the only party to appear in this action, has consented to proceed before a United States Magistrate Judge pursuant to 28 U.S.C. § 636(c). See Consent filed March 22, 2011.

By order filed April 4, 2011, plaintiff was granted thirty days in which to file an amended complaint and a completed application to proceed in forma pauperis. Plaintiff was cautioned that failure to comply with that order might result in the dismissal of this action. The thirty day period has now expired, and plaintiff has not filed an amended complaint or a complete in forma pauperis application or otherwise responded to the court's order.

Accordingly, IT IS HEREBY ORDERED that this action is dismissed without prejudice. See Local Rule 110; Fed. R. Civ. P. 41(b).
