WHEREAS, the Court set a Case Management Conference in the above-captioned matter 20 on September 9, 2011; and 21 WHEREAS, Defendant CSK Auto, Inc. d/b/a Kragen Auto Parts, improperly identified 22 as Kragen Auto Parts ("Defendant") filed a Motion to Dismiss Plaintiff's Second Amended 23 Complaint ("Motion") and set the hearing on September 30, 2011; and 24 WHEREAS, Plaintiff Barbara Mason and Defendant have met, conferred, and agreed to 25 continue the Case Management Conference to October 28, 2011, in order to provide the Court 26 time to rule on Defendant's Motion.

THEREFORE, subject to the Court's approval, the parties stipulate as follows:

Plaintiff BARBARA MASON and Defendant CSK AUTO, INC., hereby stipulate that 3 the Case Management Conference currently set on September 9, 2011 in Courtroom 11, 19th 4 Floor, Federal Building, 450 Golden Gate Avenue, San Francisco, California, be continued to 5 October 28, 2011, at 1:30 p.m. or as soon thereafter as the matter may be heard.

Respectfully submitted this 16th day of August, 2011.

THE PARTIES HAVING SO STIPULATED, the Court hereby enters and approves 15 their stipulation as the Order of this Court. The Case Management Conference is hereby 16 continued to October 28, 2011, at 1:30 p.m. in Courtroom 11, 19th Floor, Federal Building, 450 17 Golden Gate Avenue, San Francisco, California.
