Charles L. Hale, Jr v. M. D. Mcdonald

UNITED STATES DISTRICT COURT CENTRAL DISTRICT OF CALIFORNIA WESTERN DIVISION

September 13, 2011

CHARLES L. HALE, JR., PETITIONER,
v.
M. D. MCDONALD, RESPONDENT.

The opinion of the court was delivered by: Dolly M. Gee United States District Judge

ORDER ACCEPTING FINDINGS AND RECOMMENDATIONS OF UNITED STATES MAGISTRATE JUDGE

Pursuant to 28 U.S.C. §636, the Court has reviewed the Petition for Writ of Habeas Corpus ("Petition"), the records and files herein, and the Report and Recommendation of the United States Magistrate Judge ("Report"). Further, the Court has engaged in de novo review of those portions of the Report to which Petitioner has objected.

In light of the highly deferential standard which this Court must apply in reviewing Petitioner's claims, the Court accepts the findings and recommendations of the Magistrate Judge. The Court issues a Certificate of Appealability ("COA") as to Petitioner's challenge to his aiding and abetting conviction, but declines to issue a COA as to any other claim.*fn1

IT IS SO ORDERED.
