ORDER TO SHOW CAUSE REGARDING

WHY ACTION SHOULD NOT BE REMANDED FOR LACK OF SUBJECT MATTER JURISDICTION

INTRODUCTION

On July 28, 2011, plaintiff Six Angeles, Inc., as Trustee for the Robertson Blvd. Trust U.D.T., 3/23/02, filed an unlawful detainer action in Los Angeles Superior Court.

On September 9, 2011, defendant Trine El Bay removed the unlawful detainer action to this Court pursuant to 28 U.S.C. § 1331.

DISCUSSION

The question of whether a claim arises under federal law, for purposes of 28 U.S.C. § 1331, must be determined by reference to the complaint. Franchise Tax Bd. v. Constr. Laborers Trust, 463 U.S. 1, 9--10 (1983). Invoking a federal issue or provision is not "a password opening federal courts to any state action embracing a point of federal law."
