ORDER GRANTING STIPULATED REQUEST TO CONTINUE CHANGE OF PLEA AND SENTENCING DATE TO FEBRUARY 8, 2012 AND EXCLUDING TIME UNDER THE SPEEDY TRIAL ACT

The parties jointly requested that this Court continue the sentencing hearing to February 14 8, 2012 at 10:00 a.m. because additional time is needed to gather information to aid in 15 16 preparation of the Presentence Investigation Report and to allow the parties to review and submit 17 comments regarding the draft report. Further, the assigned probation officer will be out of the 18 office in the month of December. The parties agree the ends of justice served by granting the 19 continuance outweigh the best interests of the public and defendant in a speedy trial. 20 IT IS HEREBY ORDERED that the change of plea and sentencing in this matter is 21 continued to February 8, 2012 at 10:00 a.m. and that time between December 14, 2011 and 22 February 8, 2012 is excluded in accordance with the provisions of the Speedy Trial Act, 18 23 U.S.C. § 3161(h)(1)(G) for the Court's consideration of the proposed plea agreement. 24 25 26
