ORDER GRANTING STIPULATION OF DISMISSAL WITH PREJUDICE AS TO PLAINTIFF'S INDIVIDUAL CLAIMS AND WITHOUT PREJUDICE TO ANY PUTATIVE CLASS CLAIMS [F.R.C.P. 41(a)(1)(ii)] [Assigned to the Hon. A. Howard Matz]
Having considered the Stipulation of Dismissal With Prejudice as to Individual Claims and Without Prejudice as to Putative Class Claims (the "Stipulation") filed by plaintiff David Boorstein ("Plaintiff") and defendant Amazon.com, Inc. ("Amazon"), that, pursuant to Federal Rule of Civil Procedure 41(a)(1)(ii), this entire action shall be, and is, dismissed WITH PREJUDICE as to all claims asserted by Plaintiff against Amazon on an individual basis, and WITHOUT PREJUDICE as to the claims, if any, of putative class members,
IT IS HEREBY ORDERED that the Stipulation is GRANTED and the above-captioned action is hereby dismissed WITH PREJUDICE as to all claims asserted by Plaintiff against Amazon on an individual basis and WITHOUT PREJUDICE as to the claims, if any, of putative class members.
IT IS SO ORDERED.
