The Court accepts the findings, conclusions, and recommendations of the Magistrate Judge,

IT IS HEREBY ORDERED that: (1) accepting this Report and Recommendation; (2) denying Defendant De La Cruz's Motion to Dismiss the TAC pursuant to Rule 12(b)(6); and (3) ordering Defendant De La Cruz to file an Answer to Plaintiff's Eighth Amendment failure to protect claim within thirty days of the entry of the order accepting this Report and Recommendation.
