UNITED STATES DISTRICT COURT NORTHERN DISTRICT OF CALIFORNIA SAN FRANCISCO DIVISION
June 12, 2012
BETSY FEIST, INDIVIDUALLY AND ON BEHALF OF ALL MISC. OTHERS SIMILARLY SITUATED,
RCN CORP AND PAXFIRE, INC.,
The opinion of the court was delivered by: Mag. Judge: Elizabeth D. Laporte
[PROPOSED] ORDER GRANTING DEFENDANT PAXFIRE, INC.'S ADMINISTRATIVE MOTION FOR LEAVE TO FILE UNDER SEAL DOCUMENT SUBMITTED IN SUPPORT OF OPPOSITION TO PLAINTIFF BETSY FEIST'S MOTION TO QUASH SUBPOENAS TO CONSULTANTS AND REQUEST FOR PROTECTIVE ORDER
Ctrm: E, 15th Floor
Now before the Court is Defendant Paxfire, Inc.'s ("Paxfire") Administrative Motion for Leave to File Under Document Submitted in Support of Opposition to Plaintiff Betsy Feist's 3 Motion to Quash Subpoenas to Consultants and Request for a Protective Order. Upon 4 consideration of the motion and the supporting declaration of Jaideep Venkatesan filed therewith, 5 the Court finds there to be good cause for granting Paxfire's request to file documents under seal. 6 GOOD CAUSE having been shown, the Court finds that:
1. The parties possess overriding confidentiality interests that overcome the right of 8 public access to the record in the following document(s): 9 a. Letter from Ben Traynor to Peter D. Jacob attached as Exhibit O to the 10 Declaration of Andrew Grosso submitted in support of Paxfire's Opposition 11 to Plaintiff's Motion to Quash Subpoenas to Consultants and Request For Protective Order.
2. The parties' overriding confidentiality interests support sealing the record; 3. A substantial probability exists that the parties' overriding confidentiality interests will be prejudiced if the record is not sealed; 4. The proposed sealing is narrowly tailored; and 5. No less restrictive means exist to achieve this overriding interest.
IT IS THEREFORE ORDERED that Defendant Paxfire, Inc.'s Administrative Motion for Leave to File Under Seal Document Submitted in Support of Opposition to Plaintiff Betsy Feist's 20 Motion to Quash Subpoenas to Consultants and Request for a Protective Order is GRANTED.
IT IS SO ORDERED.
