MOTION TO DISMISS INDICTMENT AND[PROPOSED] ORDER DISMISSING INDICTMENT
Pursuant to Rule 48(a) of the Federal Rules of Criminal Procedure, Plaintiff, United States of America, by and through its undersigned attorney, hereby files this motion and proposed order dismissing the indictment against the defendant in the above-captioned matter.
On July 17, 2012, the defendant pleaded guilty in San Joaquin Superior Court to four counts of lewd acts upon a child in violation of California Penal Code Section 288(A), and one count of possession of child pornography in violation of California Penal Code Section 311.11(A). He was sentenced to 14 years imprisonment. He was also ordered to register as a sex offender pursuant to California Penal Code Section 290.
