ORDER SETTING HEARING ON EX PARTE APPLICATION [LINK TO 63]

Presently before the Court is Plaintiff's Ex Parte Application for Entry of Stipulated Judgment. Because of the nature of the issues raised in Defendant's opposition to the ex parte application, the Court finds it more appropriate for the matter to be fully briefed and argued. Parties are ordered to submit cross-briefs on whether the amount of the stipulated judgment is an unenforceable penalty.

Briefs shall be submitted on or before October 9, 2012. Reply briefs shall be submitted on or before October 15, 2012. The hearing shall take place on October 22, 2012, at 10:00 a.m.
