JUDGMENT AND PROBATION/COMMITMENT ORDER

NOLO CONTENDERE NOT GUILTY
There being a finding/verdict of GUILTY, defendant has been convicted as charged of the offense(s) of: Conspiracy to Defraud and to Commit Offenses Against the United States, in violation of 18 USC 371, as charged in Count 1 of the Indictment; Unlawful Kickbacks, in violation of 41 USC 51-54, as charged in Counts 2 through 7; Wire Fraud, in violation of 18 USC 1343, as charged in Count 8 of the Indictment; and Mail Fraud, in violation of 18 USC 1341, as charged in Counts 9-12 of the Indictment The Court asked whether there was any reason why judgment should not be pronounced. Because no sufficient cause to the contrary was shown, or appeared to the Court, the Court adjudged the defendant guilty as charged and convicted and ordered that: Pursuant to the Sentencing Reform Act of 1984, it is the judgment of the Court that the defendant is hereby committed to the custody of the Bureau of Prisons to be imprisoned for a term of:
It is ordered that the defendant shall pay to the United States a special assessment of $1,200, which is due immediately. Any unpaid balance shall be due during the period of imprisonment, at the rate of not less than $25 per quarter, and pursuant to the Bureau of Prisons' Inmate Financial Responsibility Program.

Defendant shall pay restitution in the total amount of $947,585 to victims set forth in a separate victim list prepared by the probation office which this Court adopts and which reflects the Court's determination of the amount of restitution due to each victim. The victim list, which shall be forwarded to the fiscal section of the clerk's office, shall remain confidential to protect the privacy interests of the victims.
Restitution shall be paid in full immediately.
The defendant shall be held jointly and severally liable with co-participants, Billy Joe Hunt, Docket No. CR11-0382-AKK-TMP pending in the United States District Court, Northern District of Alabama; and Gaines R. Newell, Jr., Docket No. CR11-00383-VEH-PWG pending in the United States District Court, Northern District of Alabama, for the amount of restitution ordered in this judgment. The victims' recovery is limited to the amount of their loss and the defendant's liability for restitution ceases if and when the victims receive full restitution.

It is ordered that the defendant shall pay to the United States a total fine of $15,000, consisting of the following: $15,000 as to counts 1 through 12. The total fine shall bear interest as provided by law.

Pursuant to the Sentencing Reform Act of 1984, it is the judgment of the Court that the defendant, Ahmed Sarchil Kazzaz, is hereby committed on counts 1 through 12 of the 12-count indictment to the custody of the Bureau of Prisons for a term of 15 months.
