FAILURE TO PROSECUTE

On September 14, 2012, this Court entered an Order Dismissing the Complaint with Leave to Amend. Plaintiff was granted thirty days leave to file an amended complaint.

Plaintiff's first amended complaint is more than four weeks overdue. Accordingly, the Court orders plaintiff to show cause in writing within 15 days of the date of this order, why this action should not be dismissed for failure to prosecute.

IT IS SO ORDERED.
