ORDER ON JOINT STIPULATION OF DISMISSAL [PROPOSED] ORDER ON JOINT STIPULATION OF DISMISSAL
TO ALL PARTIES AND TO THEIR COUNSEL OF RECORD:
Plaintiff Gregory Mayo ("Plaintiff") and Defendant Kmart Corporation have entered into a Joint Stipulation of Dismissal. After considering the Stipulation of the parties, the facts upon which the Stipulation is based, and good cause appearing,
it is hereby ORDERED:
1. Plaintiff's class claims alleged against Defendant Kmart Corporation are dismissed without prejudice.
2. Plaintiff's individual claims alleged against Defendant Kmart Corporation are dismissed with prejudice.
3. Each party shall bear her/its own costs and attorneys' fees.
IT IS SO ORDERED.
