ORDER TO SHOW CAUSE RE: FAILURE TO PROSECUTE

Now pending before the Court is Defendants' Motion to Dismiss Plaintiff's Second Amended Complaint, filed February 15, 2013. (Dkt. No. 35.) Plaintiff has not filed an 22 Opposition or Statement of non-opposition to the Motion to Dismiss, as required by Local 23 Rule 7-3(b).

Accordingly, the Court hereby ORDERS Plaintiff to SHOW CAUSE as to why 24 this action should not be dismissed for failure to prosecute. Plaintiff should file a response to 25 the ORDER to SHOW CAUSE, along with a response to the Motion to Dismiss, on or before 26 April 1, 2013. If no response is received, this action may be dismissed with prejudice, 27 pursuant to Federal Rule of Civil Procedure 41(b), for failure to prosecute. 28
