ORDER ACCEPTING REPORT AND AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE

VIRGINIA A. PHILLIPS, District Judge.

Pursuant to 28 U.S.C. ยง 636, the court has reviewed the record and the Report and Recommendation of the United States Magistrate Judge. No written objections to the Report have been received. The Court accepts the findings and recommendation of the Magistrate Judge.

IT IS THEREFORE ORDERED: (1) that Plaintiff's Second Amended Complaint be dismissed without leave to amend; (2) that Plaintiff's claim of excessive force in arrest be dismissed, with prejudice, as time-barred; (3) that, in all other respects, Plaintiff's action be dismissed for failure to prosecute and on grounds discussed in the Memorandum and Order filed March 27, 2013 (docket no. 15); and (4) that judgment be entered accordingly.
